Terms of Service

These Terms of Service (the “Terms”) are a binding agreement between you and Bestis, Inc., a Delaware corporation (“Bestis,” “we,” “us,” or “our”), governing your access to and use of the bestis.com website, applications, and related services (collectively, the “Service”). By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

1. Eligibility & accounts

The Service is private and available by invitation only. You must be at least 18 years old (or older where a higher minimum applies at registration) and able to form a binding contract to use the Service. You agree to provide accurate registration information, keep it current, and keep your credentials confidential. You are responsible for all activity under your account. Notify us immediately at [email protected] of any unauthorized use.

2. Your content

The Service lets you upload photos, item details, descriptions, messages, and other materials (“User Content”). You retain ownership of your User Content. You grant Bestis a worldwide, non-exclusive, royalty-free license to host, store, reproduce, and display your User Content solely to operate, provide, and improve the Service and as you direct through visibility settings (private, circle, friends, or public). You represent that you own or have the rights to your User Content and that it does not infringe the rights of others or violate any law.

3. Acceptable use

You agree not to:

  • violate any law or the rights of others, including intellectual property and privacy rights;
  • post content that is unlawful, counterfeit, misleading, harassing, hateful, or sexually exploitative;
  • list or sell items you do not own or are not lawfully entitled to sell, or misrepresent an item’s authenticity, condition, or provenance;
  • circumvent, disable, or interfere with the security or integrity of the Service;
  • use bots, scrapers, or automated means to access the Service without our written permission; or
  • attempt to gain unauthorized access to any account, system, or data.

4. Marketplace, borrowing & swaps

The Service enables members to lend, borrow, swap, and sell fashion items with one another. Unless expressly stated, Bestis is not a party to transactions between members and does not take title to any item. We provide tools — including escrow-style payment holding and optional authentication — to help transactions proceed fairly, but members are solely responsible for their listings, communications, item condition, shipping, returns, and the accuracy of what they represent. Fees, escrow behavior, and dispute handling are described in the Service and, where applicable, in our Refund Policy.

5. Payments & fees

Payments are processed by third-party payment providers (including Stripe). By transacting, you agree to the applicable provider’s terms. We may charge service fees, which are disclosed before you complete a transaction. You authorize us and our providers to charge your selected payment method for amounts you owe. Subscriptions, if offered, renew automatically until cancelled and are governed by the pricing and cancellation terms shown at purchase.

6. Authentication services

Where offered, authentication is an opinion provided by trained reviewers based on the information and images available to them. It is not a guarantee, warranty, or certification of authenticity, value, or legal title, and should not be relied upon as such.

7. Intellectual property

The Service, including its software, design, and trademarks, is owned by Bestis or its licensors and is protected by law. We grant you a limited, revocable, non-transferable license to use the Service for your personal, non-commercial use, subject to these Terms. All rights not expressly granted are reserved.

8. Termination

You may stop using the Service and delete your account at any time. We may suspend or terminate your access if you violate these Terms, create risk or legal exposure for us, or if we discontinue the Service. Sections that by their nature should survive termination will survive.

9. Disclaimers

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE, OR THAT ANY ITEM, LISTING, OR MEMBER IS AS REPRESENTED.

10. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, BESTIS AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM OR RELATED TO YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY FOR ANY CLAIM WILL NOT EXCEED THE GREATER OF (A) THE AMOUNTS YOU PAID US IN THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM, OR (B) US$100.

11. Indemnification

You agree to indemnify and hold Bestis harmless from claims, damages, and expenses (including reasonable legal fees) arising out of your User Content, your transactions with other members, or your breach of these Terms or of any law.

12. Governing law & disputes

These Terms are governed by the laws of the State of Delaware, United States, without regard to its conflict-of-laws principles. Subject to any applicable consumer-protection rights, you and Bestis agree that the state and federal courts located in State of Delaware, United States will have exclusive jurisdiction over disputes not subject to arbitration, and you consent to venue there.

13. Changes

We may update these Terms from time to time. If we make material changes, we will provide notice (for example, by email or in the Service). Your continued use after the changes take effect constitutes acceptance.
